Terms of Use

1. Operator, scope, and eligibility

This app is operated by Segalo Media LLC dba Four28 Marketing (referred to as Four28). “App” means this tournament website, its bracket and schedule displays, simulations, and related features. “Four28,” “we,” “us,” and “our” refer to the operator. The app is offered free of charge for informational convenience. It is intended for adults; a minor should use it only with appropriate parent or guardian supervision. These Terms do not make someone who merely selects a team an authorized representative of that team, and do not bind other people simply because a link is shared with them.

These Terms apply to this app, not to tournament registration, participation agreements, venue rules, or separately contracted Four28 services. The Privacy Policy describes information practices; it is not a blanket waiver of privacy rights.

2. Independent service; no affiliation or authority

Four28 is not affiliated with, endorsed by, sponsored by, or an agent of the United States Specialty Sports Association (USSSA), the tournament organizer, participating teams, or venue operators. References to those organizations identify the source or subject of tournament information. Their names, trademarks, logos, and other rights remain with their respective owners. Four28’s promotion in the footer does not imply their approval.

We do not organize the event, assign fields, officiate, establish eligibility, enter official scores, resolve protests, excuse late arrivals, waive forfeits, issue tournament refunds, or bind USSSA or any organizer. No partnership, agency, employment, or joint venture with those parties is created by this app or these Terms.

3. Accuracy, delays, and your verification responsibility

Published source information and our processing of it may be incomplete, incorrect, delayed, reordered, or changed without notice. Errors can arise from source changes, parsing or software bugs, bracket interpretation, corrections, cache behavior, connectivity, device settings, or human input. A successful automated check only means the implemented checks passed on a particular snapshot; it does not independently certify the event or eliminate all errors.

The app may show an older snapshot when current information cannot be obtained or verified. Refresh intervals are targets, not service guarantees. Backgrounded pages, failed connections, outages, or validation failures can delay updates. “Live,” “official,” “connected,” and similar labels describe the source or connection state; they do not mean the app is operated by USSSA or that the display is approved, complete, or current.

• Verify the correct event, division, team, opponent, date, time zone, complex, and specific diamond directly with official sources and tournament staff before each game.
• Check again after results, weather delays, rescheduling, field changes, or conflicting instructions. Do not assume a previous screenshot or shared link remains current.
• Follow current tournament-staff instructions if this app conflicts with them. Do not rely solely on this app to decide when or where to report.
• Do not treat an empty results list, missing opponent, or lack of an alert as confirmation that no game is scheduled or that your team has advanced or been eliminated.

Four28 does not undertake responsibility for monitoring every user’s circumstances or contacting each affected team. Error reporting and automated monitoring do not create a guaranteed response time or obligation to warn every visitor of every change.

4. Simulations, maps, and notifications

Simulator picks and projected routes are hypothetical planning tools. They do not submit scores, change tournament records, reserve a time or field, or predict outcomes. Championship resets and future opponents depend on actual official results and event decisions. Your saved simulation is separate from posted results.

Map links generally locate a complex, not a specific diamond, parking area, entrance, or accessible route. Addresses, labels, entrances, and directions may differ between providers. Confirm the destination and field with staff and obey posted instructions. Do not operate the app while driving. The app is not an emergency, weather-warning, navigation-safety, or event-cancellation service and does not guarantee individual alerts.

5. Availability and changes to the service

We may modify, suspend, limit, or discontinue any feature, source connection, or the entire app, including in response to an error, rights complaint, security concern, hosting limitation, or completion of the tournament. We do not promise uninterrupted access, permanent availability, support, compatibility with every device, or preservation of local simulations. Keep any information you need separately and verify it with the organizer.

6. Permitted use and conduct

You may use the app for lawful personal or team planning and share ordinary links to it. Do not impersonate Four28, USSSA, tournament staff, or another team; present simulations as official results; remove source or independence notices to mislead others; interfere with service operation; exploit security vulnerabilities; bypass access restrictions; or use automated requests that materially disrupt this app or its providers. Do not submit unlawful, infringing, threatening, or sensitive material through support channels.

These Terms grant no ownership in third-party materials and no permission to use USSSA’s trademarks, data, website, or other content beyond rights you independently hold. Any applicable third-party terms remain separate. We may restrict abusive use to protect the service.

7. Intellectual property and rights concerns

Four28 retains rights it owns in its original app code, branding, design, and written materials, subject to applicable law and third-party licenses. We do not claim ownership of underlying tournament facts, third-party names, or materials owned by others. These Terms do not establish that any particular third-party use is authorized, and do not limit rights a third party may have under applicable law.

If you believe content, branding, or source access infringes your rights or creates confusion, email info@four28.com. Identify the affected URL or material, the right asserted, your relationship to the rightsholder, and a reliable way to reach you. We may investigate, correct, remove, or suspend the disputed feature or content as appropriate. This contact process is not a claim of registered DMCA-agent status and does not replace any legally required notice procedure.

8. Third-party services and promotion

Official-source links, maps, fonts, hosting, and external business links depend on third parties outside our control. Their availability, content, accuracy, security, and terms may change. A link is not a warranty or endorsement. Four28’s footer promotes its own services; use of this free app does not create a consulting engagement or an obligation to purchase anything. Any paid work requires a separate agreement.

9. Disclaimer of warranties

To the maximum extent permitted by applicable law, the app and its information are provided “as is” and “as available,” without express, implied, or statutory warranties, including warranties of accuracy, completeness, timeliness, reliability, availability, merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the app will be error-free, uninterrupted, secure in every circumstance, or that every defect will be corrected. Informal statements, support messages, testing, or verification labels do not create a guarantee of tournament accuracy.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent allowed, and mandatory consumer rights remain intact.

10. Limitations of liability

To the maximum extent permitted by applicable law, Four28 and its personnel will not be liable for indirect, incidental, consequential, special, exemplary, or punitive losses arising from use of, inability to use, or reliance on the app. This includes, where legally excludable, lost opportunities, profits, data, goodwill, entry fees, travel or lodging expenses, missed or forfeited games, disqualification, tournament placement, or lost prizes resulting from incorrect, delayed, or unavailable information—even if such consequences were foreseeable or we were told they might occur.

To the maximum extent permitted by applicable law, Four28’s aggregate liability for all claims relating to this free app will not exceed US $100. These limitations apply regardless of the legal theory asserted, including contract, tort, or ordinary negligence, only where legally enforceable.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, intentional misconduct, gross negligence, death or personal injury where protected by law, or nonwaivable consumer or privacy rights. If a limitation is not permitted, liability is limited only to the maximum extent the law allows. These Terms do not prevent you from making a lawful complaint, reporting misconduct, or seeking a remedy that cannot legally be waived.

11. Responsibility for misuse

To the extent permitted by law, you are responsible for losses you directly cause through your intentional unlawful misuse of the app, infringement of another person’s rights, or fraudulent impersonation. Any obligation to reimburse Four28 for a resulting third-party claim is limited to reasonable losses and costs attributable to that conduct, subject to applicable law. This provision does not require you to cover errors in the app, Four28’s own wrongful conduct, or claims merely because you relied on information in good faith.

12. Errors, questions, and disputes

For urgent schedule, eligibility, weather, or field questions, contact tournament staff directly. To report an app error, email info@four28.com and include the event, division, team, game ID, displayed information, time observed, and official source if available. Avoid sending unnecessary personal information. We may review reports but cannot promise a correction before your game.

Please give us an opportunity to discuss a concern before litigation when practical. This is a request, not a mandatory waiting period, shortened limitation period, or bar to urgent relief. These Terms do not impose mandatory arbitration, a class-action waiver, or an exclusive court location. Applicable law and mandatory jurisdiction rules govern any dispute.

13. Updates and general provisions

We may revise these Terms prospectively. The effective date identifies the current version; material revisions will be identified here, with further notice or agreement where required by law. A revision does not retroactively eliminate an accrued claim or mandatory right.

If a provision is invalid or unenforceable, it will be limited or separated to the extent permitted by law, and the remaining provisions continue where lawful. Failure to enforce a provision is not a waiver of the right to enforce it later. These Terms govern this app only and do not override a separate written agreement or another party’s rights. No person is authorized to promise guaranteed game accuracy or speak for USSSA through this app.
